Dr. Ali Gomaa's Books
The Juristic Ruling According to the Scholars of Juristic Methodology / al Hukm al Shar'i 'ind al Usuliyin
Publisher: Cairo: Dar Al Salam
Dr. Ali starts his book with defining the science of Juristic Methodology and the different scholarly opinions regarding its definition. Then he extensively talks about the definition of the juristic ruling and how we can determine if this ruling can be added to jurisprudence or it is not qualified for it.
The next step after figuring out the juristic ruling is to determine the degree of the ruling whether it is obligatory, recommended, permissible, disapproved or prohibited. Dr. Ali focuses on the first ruling which is the obligatory ruling and he divides them into two categories in relevance to time so one of them is limited in time and the other gives a latitude of time to perform the juristic action in it.
In the second chapter Dr. Ali discusses certain issues which are pertinent to applying juristic rulings on certain categories of people such as if the person is coerced to do these actions.
The third chapter is dedicated to discuss the consequences of losing the object on which the juristic ruling should be applied. The last chapter talks about different issues on which different juristic rulings are applied such as the issue of prayer, slavery, the caliphate, and currency notes and bills among other issues which are pertinent to Muslims’ lives.
